2. Purpose :

These General Terms and Conditions of Sale (GTCS) govern the sale of fine art photographs offered on the website www.woodslau.com

All artworks are produced to order from Woods Lau’s original photographs and are available in a range of sizes, finishes and mounting options, as specified on each product page.

By placing an order on the website, the customer acknowledges having read and accepted these General Terms and Conditions of Sale without reservation.

3. Products :

The photographs offered for sale on www.woodslau.com are original works created by Woods Lau.

Each artwork is produced only after the order has been confirmed and is printed according to the size, finish and mounting option selected by the customer from the choices available on the relevant product page.

The essential characteristics of each artwork, including the photograph, printing medium, dimensions, finish, optional framing and price, are described on the website. Product images are presented as accurately as possible. However, slight variations in colour or appearance may occur due to differences in screen settings or the specific properties of the printing materials. Such variations shall not constitute grounds for liability on the part of Woods Lau.

All artworks are made to order by a professional local print laboratory, ensuring a consistently high standard of craftsmanship and print quality.

Woods Lau reserves the right to modify the visuals, descriptions and specifications of its artworks at any time in order to improve its products. Such changes shall not affect orders that have already been confirmed.

4. Orders :

Orders may only be placed through the website www.woodslau.com

Customers select the artwork, printing medium, size and any available options before adding the item to their shopping cart. Before confirming the order, customers are invited to carefully review all the information provided, as well as the contents of their shopping cart.

An order is considered final once payment has been successfully processed and the customer has received an order confirmation email summarizing the purchase.

Woods Lau reserves the right to refuse or cancel any order in the event of a previous dispute with the customer, confirmed or suspected fraud, payment refusal, or any other legitimate circumstance preventing the proper fulfillment of the order.

Any request to modify or cancel an order after it has been confirmed can only be considered if production of the artwork has not yet begun. Once production has started, no modification or cancellation can be accepted, as each artwork is custom-made to the customer’s specifications.

5. Exclusivity :

All orders are placed by direct contact (email). The customer specifies :  

  • The desired photo 
  • The format or need for advice
  • The frame color 
  • Whether they want exclusivity 

A preview of the result can be provided before confirmation. The order is considered final after written confirmation from the customer by email and full payment. 

6. Price and Payment :

All prices displayed on www.woodslau.com are expressed in euros (€).

As Woods Lau operates under the French micro-enterprise tax regime, VAT is not applicable in accordance with Article 293 B of the French General Tax Code (Code général des impôts). Prices are therefore displayed excluding VAT and include the statement: « VAT not applicable – Article 293 B of the French General Tax Code. »

Shipping costs are not included in the price of the artworks. They are calculated according to the size, weight and characteristics of the ordered product and are displayed before the customer confirms the order.

Woods Lau reserves the right to modify its prices at any time. However, artworks will be invoiced at the prices in effect at the time the order is confirmed.

Full payment of the order is required at the time the order is placed.

Payment for all orders is due at the time the order is confirmed, using the secure payment methods available on www.woodslau.com

All transactions are processed by a secure payment service provider. At no time does Woodslau have access to the customer’s banking or payment details.

An order is considered accepted only once payment has been successfully confirmed by the payment service provider. If the payment is declined or the transaction fails, the order will be automatically cancelled and no production of the artwork will begin.

An invoice is issued for every order and may be provided to the customer upon request or made available in accordance with the procedures set out on the website.

7. Deadlines and Delivery :

Each artwork offered on www.woodslau.com is made exclusively to order. Production begins only after payment has been successfully confirmed.

All prints are produced with the utmost care by a professional local print laboratory, selected for the quality of its craftsmanship and finishing. Every artwork undergoes a quality inspection before being shipped.

The standard production time is generally between 5 and 7 business days. This timeframe is provided as an estimate and may exceptionally be extended during periods of high demand, temporary shortages of printing materials, or any other circumstances beyond Woods Lau’s control.

Orders are shipped via Colissimo. Shipping costs are calculated according to the size, weight and characteristics of the artwork and are displayed before the customer confirms the order.

Delivery times provided by the carrier are estimates only. Woodslau cannot be held responsible for delays caused by the carrier or by any circumstances beyond its reasonable control.

The risk of loss or damage to the artwork passes to the customer upon delivery of the order to the address provided at the time of purchase.

8. Right of Withdrawal :

Customers are required to inspect both the package and the artwork immediately upon delivery.

If the package is damaged or the artwork shows any visible damage upon receipt, the customer is requested to report the damage to the carrier and to contact Woodslau within 48 hours, providing photographs of the package, the packaging and the damaged artwork. These documents will enable Woodslau to process the claim as quickly as possible.

As each artwork is custom-made according to the customer’s selected specifications (printing medium, dimensions, finish and, where applicable, framing), orders are not subject to the right of withdrawal in accordance with Article L221-28 of the French Consumer Code.

In the event of a confirmed manufacturing defect or damage occurring during transport, Woodslau will review the claim and, where appropriate, offer a reprint, a replacement or a refund for the affected artwork.

The statutory legal guarantees provided under the French Consumer Code and the French Civil Code remain fully applicable.

9. Liability :

Woods Lau makes every effort to ensure the accuracy of the information and visuals displayed on www.woodslau.com. However, slight variations in appearance, particularly with regard to colour, brightness or texture, may occur between the image displayed on a screen and the printed artwork. Such variations are inherent to display technologies and printing processes and shall not give rise to any liability on the part of Woods Lau.

Woods Lau shall not be held liable for any delay or failure to perform its obligations resulting from force majeure, unforeseen circumstances, or any event beyond its reasonable control, including but not limited to carrier failures, temporary shortages of printing materials, or natural disasters.

In all circumstances, Woodslau’s liability shall be limited to the total amount of the order concerned, to the extent permitted by applicable law.

10. Intellectual Property :

All photographs, images, texts, logos, graphic elements and other content displayed on www.woodslau.com are the exclusive property of Woods Lau and are protected under the French Intellectual Property Code.

The purchase of an artwork does not, under any circumstances, transfer any intellectual property rights relating to the photograph.
The customer acquires ownership only of the physical print.

Any reproduction, representation, distribution, modification, commercial exploitation or use, whether in whole or in part, of the artworks or any content from the website, by any means whatsoever, without the prior written consent of Woods Lau, is strictly prohibited and may result in legal proceedings in accordance with applicable law.

11.⁠ ⁠Personnal data Protection :

Personal data collected when placing an order is processed by Woodslau solely for the purpose of managing orders, processing payments, arranging deliveries and maintaining customer relations. Such data is processed in accordance with the applicable data protection laws and regulations.

Customers have the right to access, rectify, erase, restrict or object to the processing of their personal data, as well as the right to data portability. These rights may be exercised by contacting Woods Lau using the contact details provided on the website.

These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of France.

In the event of any difficulty or dispute, customers are encouraged to contact Woods Lau first in order to seek an amicable resolution.

If no amicable solution can be reached, consumers may refer the matter free of charge to a consumer mediator in accordance with the provisions of the French Consumer Code. The contact details of the appointed consumer mediator are available on the website or will be provided upon request.

If no amicable settlement can be reached, any dispute shall be submitted to the competent French courts in accordance with the applicable legal provisions.
